Terms of Service

These Terms of Service ("Terms") govern your use of AskBuni, the website and applications provided by Viremist LLC ("Viremist," "we," "us," or "our"). By using our services, you agree to these Terms.

1. Eligibility

Our services are intended for use by parents and guardians on behalf of their children. You must be at least 18 years old to create an account. Children ages 4-12 may use our app only under parental supervision and with a parent-managed account.

By creating an account, you confirm that you are the parent or legal guardian of the child who will use this app, and that you provide verifiable parental consent as required by the Children's Online Privacy Protection Act (COPPA) for the collection and use of your child's data as described in our Privacy Policy.

2. Account Responsibilities

• You are responsible for maintaining the security of your account.
• You are responsible for all activity that occurs under your account, including your child's use of the app.
• You agree to provide accurate information when creating a profile.

3. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose
• Attempt to circumvent safety features or content filters
• Reverse-engineer, decompile, or disassemble our applications
• Use our services to generate harmful, abusive, or inappropriate content
• Share your account credentials with third parties

4. AI-Generated Content

Our app uses artificial intelligence to generate answers to children's questions. While we implement safety measures to ensure responses are age-appropriate and accurate:

• AI-generated answers are for educational and entertainment purposes only.
• Answers may occasionally contain inaccuracies. We encourage parents to review answers and discuss them with their children.
• The parent approval feature allows you to review answers before your child hears them. We recommend using this feature, especially for younger children.
• AskBuni does not provide medical, mental health, legal, or financial advice. If your child has a question that touches on health, safety, or wellbeing, please consult a qualified professional.

5. Subscriptions and Billing

• AskBuni offers auto-renewing subscriptions billed through your Apple ID:
  • Monthly: $4.99 / month
  • Yearly: $49.99 / year
• Usage allowance: An active subscription includes a monthly usage allowance shared across all AI features (questions, stories, and songs). Different actions use different amounts of the allowance: as a guide, the monthly allowance is enough for up to about 600 questions, or 200 child-made stories, or 100 songs, or any combination (a story uses roughly three times, and a song roughly six times, the allowance of a question). Stories AskBuni generates automatically from your child's questions do not count toward it. The allowance resets on the 1st of each calendar month, and unused amounts do not roll over to the next month. When your monthly allowance is used up, further use of these features pauses until the allowance resets on the 1st of the next month; additional allowance cannot be purchased. Free-tier users receive a one-time free allowance (roughly the equivalent of 30 questions, in any mix of questions, stories, and songs, including a first song and a first story at no cost) before a subscription is required. The usage allowance has no cash value and is not refundable, transferable, or redeemable; it is not sold or separately purchasable, and is unlocked only by an active subscription. We may adjust the allowance, or the amount that different actions use, prospectively and with reasonable advance notice. We may also limit or suspend abnormal, automated, or abusive use.
• Payment is charged to your Apple ID at confirmation of purchase.
• Your subscription will automatically renew at the same price for the same period unless you cancel at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in Settings → Apple ID → Subscriptions on your device, or by visiting apps.apple.com/account/subscriptions.
• Free trial terms, if offered, will be clearly disclosed before purchase. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Prices and usage limits may change with notice as permitted by the App Store and applicable law.

6. Our Intellectual Property

The AskBuni app and website — including their design, code, look and feel, the Buni character, and all Viremist names, logos, and trademarks — are owned by Viremist LLC. You may not copy, modify, distribute, or create derivative works from our materials without our written permission. This section does not apply to the content you and your child create, which is covered in Section 7.

7. Your Content

"Your Content" means the questions, spoken story ideas, song and music ideas, and other material you or your child submit through the app, together with the answers, stories, and songs our AI generates from them.

• Ownership. As between you and Viremist, you and your child keep ownership of Your Content. To the extent we hold any rights in the AI-generated answers, stories, or songs created for you, we grant those rights to you for your personal, non-commercial use. Because these are produced by AI, we may generate similar content for other users, and AI-generated material may not be eligible for copyright protection.
• License to operate the service. You grant Viremist a non-exclusive, worldwide, royalty-free license to store, process, reproduce, and display Your Content back to you solely to provide and improve the service, for example, to generate a story, let you review it, and play it back. We do not publish Your Content or display it publicly.
• Deleting your content. You can delete individual questions and stories in the app, and delete your entire account via Settings → Delete Account. When you do, we end the license above and delete the content as described in our Privacy Policy (we may keep limited backup or legally required copies for a short period).
• Your promises about Your Content. You represent that you have all rights and permissions needed to submit Your Content and to let us use it as described, and that Your Content does not infringe anyone's intellectual-property rights or violate anyone's privacy. If Your Content names or describes another person — including another child — you confirm you have the right to include them.

8. Limitation of Liability

To the maximum extent permitted by law, Viremist shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time via Settings → Delete Account in the app. Upon termination, your right to use our services ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes through our app or website. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in California, and by using our services you consent to the jurisdiction of those courts.
